These General Terms and Conditions of Sale (“Terms of Sale”) govern sales made on the KMKPARIS.COM website.
Any order placed on the website implies unreserved acceptance of these General Terms and Conditions of Sale.

1. SELLER IDENTIFICATION
The KMKPARIS.COM website is operated by KMK PARIS.
Complete legal information (company name, SIRET number, registered office address and intra-Community VAT number) will be specified in the Legal Notice once the business is officially registered.

2. PRODUCTS
KMK PARIS sells premium home fragrance products, including:
- Room Sprays
- CERA
- SOCLE
- Permanent collections and limited editions
The photographs, descriptions and images on the website are provided for information only and are not contractually binding.

3. PRICES
Prices displayed on KMKPARIS.COM are in euros (€), inclusive of all taxes, excluding delivery charges.
KMK PARIS reserves the right to change its prices at any time.
The applicable price is the one displayed when the order is confirmed.

4. ORDER
The customer selects the products they wish to purchase and confirms their order after checking their cart.
The order is considered final after:
- payment validation;
- receipt of the order confirmation email.
KMK PARIS reserves the right to refuse any order in the event of:
- suspected fraud;
- a previous dispute;
- incomplete information;
- abusive behaviour.

5. PAYMENT
Payment is due immediately when the order is placed.
Payments are secured through third-party providers such as Stripe or any other secure payment system used by the brand.
KMK PARIS never has access to the customer’s full banking details.

6. DELIVERY
Products are dispatched to the address provided when placing the order.
Delivery methods currently offered:
- Standard Delivery: 4,99€
- Express Delivery: 10,99€
Delivery times are estimates.
KMK PARIS cannot be held liable for delays attributable to the carrier or to events beyond its control.

7. PREORDERS
Some products may be sold on preorder.
By confirming a preorder, the customer accepts longer dispatch times than for a standard order.
Dates communicated are estimates and may change.

8. RIGHT OF WITHDRAWAL
In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for products that have been opened, used or unsealed, for reasons of hygiene and health protection.
For any unopened and unused product, the customer has a statutory period of 14 days after receipt to request a return.
Return costs remain the customer’s responsibility.

9. DAMAGED PRODUCTS OR ERRORS
In the event of a damaged product or an order error, the customer must contact KMK PARIS within 48 hours of receipt.
The request must include:
- the order number;
- photographs of the parcel;
- photographs of the product concerned.

10. LIABILITY
KMK PARIS cannot be held liable for:
- misuse of products;
- improper use;
- an allergic reaction related to individual sensitivity;
- indirect damage arising from use of the products.
It is the customer’s responsibility to follow the precautions for use stated on the products.

11. INTELLECTUAL PROPERTY
All elements on KMKPARIS.COM are protected by intellectual property law.
This includes in particular:
- the KMK PARIS name;
- logos;
- images;
- texts;
- packaging;
- graphic creations;
- product concepts.
Any reproduction or exploitation without prior written permission is prohibited.

12. PERSONAL DATA
Data collected on the website is used only for:
- processing orders;
- customer management;
- shipments;
- commercial communications (with consent).
KMK PARIS undertakes to protect its users’ personal data in accordance with the GDPR.

13. FORCE MAJEURE
KMK PARIS cannot be held liable for failure to perform its obligations in cases of force majeure, including:
- a natural disaster;
- a strike;
- a pandemic;
- a transport interruption;
- an IT failure;

14. GOVERNING LAW
These General Terms and Conditions of Sale are governed by French law.
In the event of a dispute, an amicable solution will be preferred before any legal proceedings.
